What is Mietpreisbremse (rent control)?

The rent control (Mietpreisbremse) is a law that has been in force since June 2015 in almost all German states (except Saarland, Saxony and Saxony-Anhalt). Landlords are no longer allowed to take excessive rents. A maximum of 10% above the rent index is permitted. If you pay more, you can demand a rent reduction, even during the current tenancy. How much does it costs to lower the rent with the Mietpreisbremse (rent control)?

The contingency fee for claims involving the Mietpreisbremse is a one-time payment of 4x the amount you will be saving each month (inclusive of VAT). We only earn something if we actually successfully lower the rent for you. If we don't succeed, no matter why, we get nothing.The contingency fee for claims involving the Mietpreisbremse is a one-time payment of 4x the amount you will be saving each month (inclusive of VAT).Usually, you do not pay anything directly to us. Our fee comes from the security deposit you have already paid to your landlord. As your rent is reduced, your needed security deposit is also reduced, and your landlord will pay the extra (which works out as 4x your new monthly savings) directly to us. If the case goes to court, we take care of all additional costs.

How does the rent control (Mietpreisbremse) work?

In principle quite simple: When renting a new apartment, the landlord may not demand an excessive rent. A maximum of 10% above the local rent is allowed. If you have to pay more, you can also demand a rent reduction during the current rental period and reduce the excess rent. The problem lies in the details: The tenant must activate the rent control by means of a so-called qualified letter of complaint, otherwise the landlords is entitled to simply keep the excess rent received. The qualified letter of complaint must meet a number of legal requirements and needs to show with the help of the rent index why the rent is too high. Additionally, the landlord can try to invoke various exceptions to the rent control (see question on exceptions to the rent control).

Will wenigermiete.de represent me in court?

Yes, if it is not possible to reach an out-of-court settlement and we consider the judicial enforcement to be promising, we will also take legal action in court. The costs will be borne by us, of course.
